Welcome to Seaway.fo, operated by Seaway Adventures. By accessing or using our website and booking our services, you agree to comply with these Terms and Conditions. If you do not agree, please refrain from using our website and services.

1. Booking Policy

Bookings and Payments: All bookings are processed through our partner, Fríða. Payments must be made in full at the time of booking.
Booking Confirmation: Bookings are confirmed only when you receive a confirmation email from Seaway Adventures. We reserve the right to cancel or modify bookings in cases of system errors or unforeseen circumstances.
Cancellation and Refunds: A full refund is available if cancellations are made at least 24 hours before the scheduled departure. Cancellations within 24 hours are eligible for a refund only in cases of documented medical emergencies.
Modifications: Any requests to reschedule or modify bookings must be submitted at least 24 hours before departure, and approval is subject to availability.

2. Health and Safety Recommendations

For customers with back issues or similar health concerns, we recommend exercising caution or avoiding our tours. Participation is at the customer’s discretion and risk, and we assume no responsibility for health-related issues arising during the tour.

3. Force Majeure

Seaway Adventures is not liable for any cancellations or changes due to circumstances beyond our control, including but not limited to weather conditions, natural disasters, government restrictions, or other force majeure events.

4. Customer Responsibilities

Customers are responsible for arriving at the designated location on time, following safety instructions provided by our team, and ensuring they are physically fit to participate in the tour. Seaway Adventures is not responsible for delays or inability to join tours due to late arrival or personal health issues.

5. Liability and Indemnification

Limitation of Liability: Seaway Adventures assumes no responsibility for any injuries, accidents, or damages that may occur during tours. By booking with us, customers agree to release Seaway Adventures from liability for such incidents.
Indemnification: Customers agree to indemnify and hold Seaway Adventures harmless from any claims, damages, or losses resulting from their breach of these Terms or negligence.

6. Intellectual Property

Website Use: All content on our website, including photos, logos, and text, is the property of Seaway Adventures or is used with permission. Customers may not use, reproduce, or distribute our content without prior written consent.
Prohibited Actions: Users are prohibited from using our website for any unlawful activity or attempting to disrupt our services.

7. Data and Privacy

Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

8. Review Request

As part of our commitment to continuously improving our services, Seaway Adventures may send a one-time review request email to guests after their tour. This email will be sent only to those who have completed a tour and is solely intended to gather feedback about your experience. This email is a part of our service.

Please note:

This review request is a one-time email, separate from any marketing communications.
You will not receive any additional promotional emails unless you have explicitly opted in to receive them by subscribing to our newsletter.
If you would prefer not to receive this one-time feedback request, please inform us, and we will ensure you do not receive this follow-up email.

9. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.

10. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11. Governing Law

These terms are governed by the laws of the Faroe Islands, and disputes will be resolved exclusively within its jurisdiction.
